- EXPIRATION: Quotations are good for 30 days. Usually, pricing will remain the same after the expiration date but we reserve the right to update pricing and terms at any time thereafter.
- SUBSTITUTION: We reserve the right to substitute garments of like quality (same color, weight, style, etc.) in the event of shortages unless specifically requested not to by the customer when placing the order.
- PROTECTED ARTWORK: The customer placing any order is absolutely responsible for obtaining permission from the owners and or copyright or trademark holders to use logos or other protected artwork in designs submitted to Graphic FX or commissioned to be created by Graphic FX. By submitting art, text, or logos to us – or by asking us to create artwork – you are explicitly accepting all responsibility for any copyright or trademark infringement that may occur from the use of that art. Artwork of questionable ownership will require a signature release.
- COPYRIGHT: Graphic FX will retain all artwork copyright and ownership rights for logos and designs created by Graphic FX for any purpose. Upon written request, ownership or reproduction rights can be transferred to the customer in a separate contractual agreement. Limited reproduction rights will usually be granted for a specific purpose at no cost.
- ARTWORK APPROVAL: The customer must approve the final artwork design for custom printed orders before production will begin. Proofs will be made available in electronic and/or hard copy versions. Once approved by the customer Graphic FX will not be responsible for any real or perceived flaws in the design as applied to the garment. This means that if you approve the artwork – and we apply it to the garment the way you approved it – we are not responsible for any omissions, spelling, composition, or other design errors.
- REPLACEMENT/REFUND: Graphic FX will replace garments or refund the purchase price of garments, at our option, that the customer shows are defective or flawed in material or printing quality excluding design flaws not materially different from approved proof.
- PAYMENT: A deposit of at least 50% of the total order cost will be required before production begins on any custom-printed orders for new or existing customers. The balance of the order cost will be payable upon receipt of the merchandise. We reserve the right to allow checks to clear the banking system before beginning production. Other payment terms are available through a separate agreement.
